Legal Agreement and Binding Nature

These Terms and Conditions constitute a legally binding agreement between you and PM Excellence Academy governing your participation in our project management certification programs and use of our educational services. By enrolling in our courses or using our website, you acknowledge that you have read, understood, and agree to be bound by these terms.

Important Notice: These terms create legal obligations and may limit your rights. If you do not agree with any provision, you must not use our services or enroll in our programs.

Legal Responsibilities

As a participant in PM Excellence Academy programs, you bear specific legal responsibilities and obligations that are essential for maintaining the integrity of our educational environment.

1. Compliance with Laws and Regulations

You must comply with all applicable local, national, and international laws while participating in our programs. This includes but is not limited to laws regarding data protection, intellectual property, professional conduct, and educational standards.

2. Academic Integrity and Professional Ethics

You are legally bound to maintain the highest standards of academic integrity, including prohibition of plagiarism, cheating, unauthorized collaboration, or misrepresentation of credentials or achievements.

3. Truthful Information and Documentation

You are legally obligated to provide accurate, complete, and truthful information during enrollment, assessment, and all interactions with our academy, instructors, and fellow students.

Conduct Requirements

Professional Behavior Standards

  • Maintain respectful, professional communication in all interactions
  • Respect intellectual property rights of the academy and fellow students
  • Adhere to project management professional codes of conduct
  • Protect confidential information shared during courses

Prohibited Activities and Behaviors

The following activities are strictly prohibited and may result in immediate termination and legal action:

Unauthorized distribution of course materials
Harassment, discrimination, or intimidation
Fraudulent representation of qualifications
Interference with educational processes
Violation of privacy or confidentiality
Unauthorized commercial use of materials

Content Guidelines and Restrictions

All content you create, submit, or share as part of your coursework must comply with our content guidelines:

Original Work: All submissions must be your original work or properly attributed

Professional Language: Use appropriate, professional language in all communications

Relevant Content: Keep discussions and submissions relevant to course objectives

Respectful Discourse: Maintain constructive, respectful dialogue in all interactions

Age Verification and Legal Capacity

By agreeing to these terms, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are accessing our services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Educational Outcomes

We do not guarantee specific educational outcomes, career advancement, salary increases, or employment opportunities

Certification Success

Success in external certification exams (PMP, CSM, etc.) depends on individual effort and is not guaranteed

Service Availability

Services are provided "as is" without warranty of uninterrupted access or error-free operation

Limitation of Liability

Direct Damages

PM Excellence Academy's total liability for any claims arising from these terms or your use of our services shall not exceed the total amount paid by you for the specific course or service giving rise to the claim.

Consequential Damages Exclusion

Under no circumstances shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Third-Party Actions

We are not responsible for actions, content, or services provided by third parties, including certification bodies, employers, or other educational institutions.

Force Majeure Provisions

PM Excellence Academy shall not be liable for any failure or delay in performance under these terms which is due to circumstances beyond our reasonable control, including but not limited to:

  • • Natural disasters or extreme weather
  • • Government actions or regulatory changes
  • • Public health emergencies or pandemics
  • • Labor strikes or work stoppages
  • • Technology failures or cyber attacks
  • • Supplier or vendor failures
  • • Acts of terrorism or civil unrest
  • • Other circumstances beyond reasonable control

In such events, we will make reasonable efforts to minimize disruption and provide alternative arrangements when possible.

Indemnification

You agree to indemnify, defend, and hold harmless PM Excellence Academy, its officers, directors, employees, and agents from any claims, damages, costs, or expenses (including reasonable attorney fees) arising from:

  • Your violation of these terms and conditions
  • Your use of our services in violation of applicable laws
  • Infringement of third-party rights by your actions or content
  • Any false or misleading information you provide

Legal Information and Dispute Resolution

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law principles.

Exclusive Jurisdiction

Any legal proceedings shall be conducted exclusively in the courts of Colombo, Sri Lanka

Applicable Laws

Subject to Sri Lankan consumer protection, data protection, and education sector regulations

International Students

International participants agree to Sri Lankan jurisdiction regardless of their country of residence

Dispute Resolution Procedures

Step 1: Direct Resolution

All disputes should first be addressed through direct communication with our student services team within 30 days of the issue arising.

Step 2: Formal Mediation

If direct resolution fails, disputes may be referred to professional mediation services in Colombo, with costs shared equally between parties.

Step 3: Legal Proceedings

As a last resort, unresolved disputes shall be submitted to the exclusive jurisdiction of Sri Lankan courts as specified above.

Severability Clause

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect.

Reformation: In the event of severability, the parties agree to work in good faith to replace any invalid provision with a valid provision that achieves the same or similar purpose.

Terms Modification Policy

Amendment Procedures

PM Excellence Academy reserves the right to modify these terms at any time. Material changes will be communicated to enrolled students at least 30 days in advance.

Acceptance of Changes

Continued use of our services following term modifications constitutes acceptance of the revised terms. Students who disagree may withdraw with prorated refunds where applicable.

Version Control

Previous versions of terms remain accessible for reference, and the effective date clearly indicates when current terms became applicable.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any specific course enrollment agreements, constitute the entire agreement between you and PM Excellence Academy regarding your use of our services. These terms supersede all prior or contemporaneous communications, representations, or agreements relating to the subject matter herein.

Legal Compliance and Regulatory Matters

Educational Standards Compliance

PM Excellence Academy operates in compliance with Sri Lankan educational standards and regulations governing professional development and certification training.

Accreditation Standards

Our programs meet international project management education standards and PMI requirements

Data Protection Compliance

Full compliance with applicable data protection and privacy regulations

Adherence to consumer rights and protection legislation

Regulatory Reporting and Compliance

We maintain compliance with relevant regulatory bodies and may be required to report certain information or incidents as mandated by law. This may include but is not limited to educational outcome reporting, financial record keeping, and student progress tracking.

International Legal Considerations

For international students or corporate clients, additional legal considerations may apply based on bilateral agreements, international education standards, or cross-border service delivery requirements. Such additional terms will be communicated separately when applicable.
